Grandfather Gets Arrested for Holding Burglar at Gunpoint While Waiting for Police to Arrive

A New Hampshire grandfather has been arrested and is facing a possible prison sentence for firing a shot into the ground and holding a burglar at gunpoint until the cops could arrive. Dennis Fleming, 61, came home on Saturday night to discover that his home had been robbed. He saw the burglar, Joseph Hebert, 27, climbing out of his neighbor’s window. Mr. Fleming yelled, “Freeze!” and fired a shot into the ground before holding the crook at gunpoint.

When the police arrived, they arrested Hebert, but instead of a big old “thank you” and a slap on the back for Fleming, he got arrested too, on a charge of reckless conduct.

Never fire a warning shot, if he had just shot the criminal, this wouldn't have been a story.

I'll be honest, I don't see the need for a safety God forbidding someone's in my home.

However, the last thing they'll hear from me is the first, and final warning.

That wouldnt come into play here anyway. Look, I'm glad the guy isnt going to jail, but I happened to be vacationing up there when this happened, and there were a few more details to this story in the local news then most of the progun people are mentioning.

Basically, old guy comes home, notices stranger with a backpack on street, walking away from his house. Goes inside, sees he's been robbed, and figures out 2+2=stranger with backpack. Grabs his .38 and gets in his truck and starts driving around looking for backpack dude. Drives around the neighborhood for awhile, eventually sees backpack dude coming out the window of someone else's house. Grandpa yells FREEZE and pops off a round for good luck.


There is just so much fail in this story. I'm glad old dude isnt going to jail, but he did need a slap upside the head for being a dumbass.
